PERM Labor Cert. Cases

PERM is an acronym which stands for Program Electronic Review Management system.

For those who are considering filing a PERM case, it is essential to discuss the following items with your employer:

1.       It will be necessary to create an on-line account with the DOL, and a sub-account for the attorney, so that the ETA 9089 application can be filed on-line. For cases filed on-line, processing time should be within 90 days. (www.plc.doleta.gov)

2.       For professional jobs, there will need to be 3 mandatory recruitment efforts made, and 3 additional discretionary ones, for a total of 6.

A)        Mandatory

             i)     30 days in State Job Bank

ii)    One Sunday ad in major local paper

iii)    Either another Sunday ad in local paper or one ad in professional journal.

B)        Discretionary

i)                Job fair

ii)              On-campus recruiting

iii)            Employer web site

iv)            Trade or professional organization

v)             Job search web site

vi)            Private employment firm

vii)          Employee referral program

viii)         Campus placement office

ix)            Local or ethnic newspaper

x)             Radio or TV

There will also be a required wage survey, which is valid only for 90 days, and many deadlines to monitor, as 5 of the 6 recruiting methods must be less than 6 months old and more than 30 days old at time of filing.
