I am happy to provide you some basic information about the H-1B visa. An H-1B visa is valid for up to six years, and may be obtained in three-year increments. The applicant must: 1) have a bachelor's degree or its equivalent; 2) perform a professional job; 3) receive the prevailing wage for the position as determined by the local Department of Labor; and, 4) have a degree in the same or related field as the job offer. The legal fee for this type of petition is $1,200.00 and the current CIS filing fee is $185.00 + $1500 (or $750 if fewer than 25 employees) + $500 anti-fraud fee.

If your company is classified as "H-1B dependent" (if the company employs 1-25 workers and 8 or more of them are H-1B aliens, for example), then the H-1B applicant must be offered a salary of $60,000 or must have an M.S. degree.

Visas for FY2005 are already gone. Cases may be filed on April 1, 2005 in order to obtain a visa for 10/01/2005, when the quota for FY2006 will be available.

In order to get a decision within 2 weeks, an expedite fee of $1,000.00 may be paid. This is known as the "premium processing fee" program, and it is available for H, O, & L cases.

4. Copy of all I-20's (F to H only)
5. Copy of degree and transcripts (if available)

9. Complete Job Description and Job Requirements
10. Annual Salary
11. Client Contact Sheet
12. Copy of Current H-1B Approval Notice (If you are applying for an H-1B extension/employer transfer)
13. Name and title of person signing forms
14. Company Tax I.D. #
15. Annual Report/ Company brochure with product information (for records only)
16. Date Company Established
17. Approximate Number of Employees
18. How many employees are aliens
19. Approximate Gross Income for most recent fiscal year
20. 5-6 pages of Company Letter head
